These Terms govern business use of the FHIR Pilot website and preflight services. FHIR Pilot is a Digital Cognitive Solutions product operated by SERGEI FEDOTOV PR Veb portali Novi Sad, MB 67268733, PIB 114026461 (“FHIR Pilot”, “we”, “us”). See the Legal Notice for the registered address and contact details.
1. Business service and acceptance
By submitting a request, approving a scope or using a deliverable, you confirm that you are acting for a business or professional purpose, have authority to accept these Terms, and will comply with the Acceptable Use Policy. A service order exists only when both parties confirm the written scope, deliverables, timing and any fee.
2. Scope of the service
FHIR Pilot provides a version-pinned engineering-readiness preflight for agreed FHIR test environments or sanitised evidence. A scope may include a complete matching official US Core or SMART Inferno suite, baseline FHIR diagnostics, or another confirmed test kit. The deliverable records the suite and version, selected groups, prerequisites, executed, passed, blocked, skipped, unsupported and not-executed results, evidence, remediation suggestions and a hand-off recommendation.
3. What the service is not
FHIR Pilot is not official certification, a regulatory approval, penetration test, legal opinion, clinical validation, warranty of interoperability or substitute for your own release and security review. A “passed” result applies only to the recorded checks and evidence at the recorded time.
4. Your authority and responsibilities
You must own or have explicit authority to test every supplied environment and must provide accurate scope information. You must not submit production access, protected health information, patient-identifiable data, secrets or third-party endpoints without authority. You remain responsible for your system, release decision, clinical safety, data protection and partner obligations.
5. Access and data boundary
Connected work is limited to an authorised non-production route and the interactions required by the written scope. Public unauthenticated endpoints may use the connected route; credentialed execution uses zero-access unless a separate secure-access gate is approved. The zero-access route keeps execution and secrets within your environment. Do not send credentials or endpoint URLs through the public form or ordinary email.
6. Free diagnostic
The launch diagnostic is offered at no charge for one accepted scope. We may decline a request that is unauthorised, unsafe, outside the published boundary, technically unsupported, abusive or operationally unavailable. A free request does not guarantee acceptance, a specific result or future availability.
7. Paid work, invoices and cancellation
No fee is charged from the public request form. Paid work begins only after written scope and price approval. Prices are in USD unless stated otherwise and exclude applicable taxes. Unless an order says otherwise, invoices are due on receipt and fees for completed work are non-refundable. If we cancel before work starts, no fee is due; if we cannot complete an accepted scope, we will cancel or agree a proportionate adjustment.
8. Customer materials and deliverables
You retain ownership of your materials. You grant us a limited right to use authorised, non-sensitive materials solely to perform the agreed service. We retain our methods, software, templates and general know-how. After payment, you may use the delivered report internally and share it with relevant partners, provided its scope, limitations and labels remain intact.
9. Confidentiality
Each party will use reasonable care to protect non-public business information received for an agreed scope and use it only for that work. Confidentiality does not cover information already lawfully known, public without breach, independently developed or required to be disclosed by law. The public intake is not a channel for confidential technical access details.
10. Service changes and availability
We may improve, limit or discontinue website features and launch offers. Public demo endpoints and third-party test systems can change independently. We do not promise uninterrupted availability, and reference sample results may differ on later runs.
11. Disclaimer and liability
To the extent permitted by law, the service and deliverables are provided on an “as is” and “as available” basis. We disclaim implied warranties. Neither party is liable for indirect, incidental, special or consequential loss. Our total liability relating to a paid order is limited to the amount paid for that order; for a free diagnostic it is limited to EUR 100. These limits do not exclude liability that cannot legally be limited.
12. Suspension and termination
We may suspend or end work immediately for an unsafe or unauthorised request, prohibited data, non-payment or material breach. Sections intended by their nature to survive—including payment, intellectual property, confidentiality, disclaimers and liability—continue after termination.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. The parties will first try in good faith to resolve a dispute in writing. Courts with jurisdiction over our registered Serbian business location will have exclusive jurisdiction unless mandatory law requires otherwise.
14. Contact, trademarks and changes
